Terms & Conditions for All Catering Orders

 

1.
DEPOSITS, PAYMENTS, AND COLLECTION
 

DEPOSITS

Deposits are not required. Payment is
collected upon delivery or pickup. Exceptions applied to large events.
 

PAYMENT

For security reasons, we do not accept cash.
The following payment methods are accepted:

-Company check

-Credit card

-American Express

-Mastercard

-Visa 

Deposits are required for catered events over
$2500. 50% of the invoice is due at time of contract signing and acceptance by
the client.

Viva will refund deposits for events
canceled within eleven (11) days prior to the scheduled date.
 

Cancellations within 10 days
of the scheduled event, the deposit will not be refunded.

 Cancellations within 9 days of the event will

result in a full invoice charge.

COLLECTION

No deposits are taken at the time of delivery
for orders under $2000.

Credit Card: We collect 100% of any order
purchased by credit card on the day of the scheduled delivery.

 Corporate & House accounts are available.

2.
ORDERING GUIDELINES

 ORDER

POLICY: Due to the time it takes to prepare food orders, all
orders need to be received by 4 pm the day prior to your event. (Please note
that some menu selections may require additional notice or substitution may
be required).
  

LAST MINUTE OR SAME DAY ORDERS

We accept last minute (same day orders) or
after 4 pm the day before. Please note that product selection may be limited, so
your flexibility is appreciated.

FUTURE ORDERS

You may place your catering order online for
pickup or delivery up to four weeks in advance.
 

ORDER MINIMUMS

All prices are per person, minimum of 6 people
per dish unless otherwise stated. We have a $150 minimum per order.
 

DELIVERY

It is important for us to facilitate your
delivery orders to the best of our ability. Please inform us of any special
security requirements or elevator restrictions in your building so we can make
the proper arrangements for easy delivery. All delivery personnel will have
proper identification.

 STAFF CHARGES: 

We can provide professional on-site staff for your event (servers, bartenders, Chefs). Billing hours include event production from port to port with set up, food service, breakdown and cleanup of food and beverage items. Any additional hours not included in the original contract will be added to your invoice.

OUR SERVICE

Hours of Operation Monday – Friday 6:00 AM – 7:00 PM

Either online or by phone at 1-212-203-2149,
we are available to provide you with service seven days a week. If you need
a catering service that is not within our regular schedule, please call us and
we’ll do our best to accommodate your needs.

4.
DELIVERY AREA

We deliver to the entire island of Manhattan,
Bronx, Queens, and Brooklyn. A 10% service fee will be applied to every order.
 

Please Note: Deliveries above 110th Street in
Manhattan and deliveries to boroughs other than Manhattan are subject to a
$1000 minimum order and 10% service fee.
 

5.
DELIVERY METHODS

Viva will deliver to you based on the agreed-upon area detailed in section 4.

 6.
ORDER CANCELLATION AND CHARGES

We allow you to cancel or make changes via
email to your catering order without penalty as long as you notify us at least
24 hours prior to your delivery.

Change your delivery date and time.

Add or decrease the quantity of an item.

Remove items from your order.

Change special instructions. 

FINAL GUEST COUNT:

 The final count for all food and beverage orders is due one
day prior to the event.

7.
PRICING

All menu items are priced per guest unless otherwise
noted. Prices do not include sales tax. All prices on our menus and website are
subject to change without notice. All food products are chosen based upon
availability.

We are not responsible for weather changes or
price increases due to shortages of power, supply and demand or any unforeseen
situation in the food or labor market. 
Appropriate notice will be given to the client.

8.
MENU AND PRESENTATION

Items are elegantly displayed on disposable
plateware, if requested, on ceramic platters, baskets, or silver trays. Please
reach out to Viva for more options this will affect the quote.

Paper supplies and appropriate condiments are
always included with all orders at no additional cost.
 

9.
CUSTOMIZED ORDERS AND DIETARY REQUESTS

Special dietary needs and customized menu
creation can only be accommodated via phone or email.

10.
GRATUITY

Although gratuities are not automatically
included in your invoice and are not required, they are very much appreciated
by the staff. You may add a gratuity to your orders before or after the event.

11.
CANCELLATIONS AND REVISIONS POLICY

The day prior to the event the
cancelation is free of charge. Exceptions applied to the large events.

For orders over $2500 a 50%
deposit is required 7 days prior to the event. The cancelation 48-hours prior
to the event is free of charge.

The same day cancelation is fully charged, with no refunds. 

12. GENERAL POLICIES

CERTIFICATES OF INSURANCE: The COI sample needs to be
submitted at least 48 hours prior to the event by the customer.
 

BREAKAGE/LOSS/LIABILITY: Client assumes full
responsibility for any damage or loss of any equipment, including but not
limited to tents, tables, chairs, linens, glassware, décor, china, coffee urns
or flatware.

 Any lost, stolen or damaged equipment will be charged to the client at replacement cost.

All equipment should be present
and ready for pick up by Viva after the event (the day of the event or the next
day). If Viva’s staff is not on-site for the event, the client is responsible for
the safety of all food setup and serving including any heated chafing dishes
left on site.

 Viva Events & Catering does

not accept responsibility due to negligence by the client or any attendees of
the client’s event that causes any damage as a result.
 

PRIVACY: Any orders placed on Viva
Events & Catering website or directly with our staff will be kept private
and used solely for the purpose of completing your order. All client emails
will be saved in our system and included in future Viva Events & Catering
mailings regarding updates, information or promotions related to our company.
Your email or order information will never be shared or sold to any outside
party at any time. Should you wish to be removed from our email list, you can
opt-out at any time.

Our payments made by credit
cards are by a secure encrypted credit card processing system to ensure the
safety and privacy of all transactions.
